7 An Act relating to schools; amending 70 O.S. 2021,
Section 3-101, which relates to the State Board of
8 Education; modifying membership of the Board;
requiring Senate confirmation for certain
9 appointments; providing for members to serve at the
pleasure of the appointing authority; directing
10 vacancies to be filled by the appointing authority;
providing for initial appointments within specified
11 time; establishing termination date for initial
appointments; and providing an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3-101, is
17 amended to read as follows:
18 Section 3-101. A. The State Board of Education shall consist
19 of seven (7) eleven (11) members. The State Superintendent of
20 Public Instruction shall be a member and the chairperson of the
21 Board. The remaining six ten (10) members shall be appointed as
22 follows:
23 1. Six (6) members appointed by the Governor by and with the
24 advice and consent of the Senate. Except as otherwise provided for

1 in subsection B of this section, upon assuming office each Governor
2 shall appoint one member from each congressional district and one
3 member from the state at large.;
4 2. Two (2) members appointed by the Speaker of the Oklahoma
5 House of Representatives, one which shall be a rural resident of the
6 state and one which shall be a former school superintendent from a
7 district with an enrollment of less than ten thousand (10,000)
8 students; and
9 3. Two (2) members appointed by the President Pro Tempore of
10 the Oklahoma State Senate, one which shall be a rural resident of
11 the state and one which shall be a former school superintendent from
12 a district with an enrollment of more than ten thousand (10,000)
13 students.
14 Each appointment shall be made to take effect on April 2. The term
15 of each appointed member shall be four (4) years. Appointed members
16 shall serve until a successor is appointed. Appointed members shall
17 serve at the pleasure of the Governor appointing authority. Upon
18 the occurrence of a vacancy the same shall be filled by the Governor
19 appointing authority, subject to confirmation by the Senate at the
20 next session of the Legislature if the vacancy is a member appointed
21 by the Governor. The appointment to fill a vacancy shall be made
22 for the unexpired term.
23 B. On the effective date of this act, all appointed positions
24 of the current State Board of Education shall be deemed vacant and

1 the terms of persons serving on the Board shall be deemed
2 terminated. The Governor appointing authorities shall make initial
3 appointments pursuant to the provisions of this subsection within
4 thirty (30) days of the effective date of this act, with one member
5 appointed from each congressional district and one member appointed
6 from the state at large. The appointments Members appointed by the
7 Governor shall be subject to confirmation by the Senate at the next
8 session of the Legislature. The terms for members appointed
9 pursuant to this subsection shall terminate on April 2, 2015 2024.
10 Thereafter, members shall be appointed as provided for in subsection
11 A of this section.
12 C. No person shall be eligible to be appointed to serve on the
13 State Board unless the person has been awarded a high school diploma
14 or certificate of high school equivalency. Any member appointed to
15 the State Board shall complete the workshop requirements of a new
16 school board member pursuant to Section 5-110 of this title within
17 thirteen (13) months following or preceding the appointment of the
18 member. Notwithstanding any provision of law to the contrary, the
19 State Department of Education shall not charge any member of the
20 State Board of Education a fee for any workshop provided by the
21 Department for board members pursuant to Section 5-110 of this title
22 and shall not pay a fee to any organization or institution of higher
23 education on behalf of a member of the State Board of Education, or
24 reimburse any member of the Board for a fee paid to any organization

1 or institution of higher education, for attendance at a workshop or
2 courses to satisfy the requirements of Section 5-110 of this title.
3 D. Members of the Board shall receive necessary traveling
4 expenses while in the performance of their duties in accordance with
5 the State Travel Reimbursement Act.
6 SECTION 2. This act shall become effective November 1, 2023.
