7 An Act relating to student drivers; creating the Hope
Shaffer Act; prohibiting student driver from
8 operating a motor vehicle when other students are
passengers; providing an exception; requiring
9 specified statement be included in waiver;
prohibiting refusal of service in certain cases;
10 defining term; providing for noncodification; and
providing for codification.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
15 SECTION 1. NEW LAW A new section of law not to be
16 codified in the Oklahoma Statutes reads as follows:
17 This act shall be known and may be cited as the "Hope Shaffer
18 Act".
19 SECTION 2. NEW LAW A new section of law to be codified
20 in the Oklahoma Statutes as Section 19-124 of Title 70, unless there
21 is created a duplication in numbering, reads as follows:
22 A. Except as provided in subsection B of this section, each
23 commercial driver training school as defined in Section 801 of Title
24 47 of the Oklahoma Statutes or school district providing driver

1 education training or classes shall only allow a student driver
2 receiving instruction to operate the motor vehicle when there are no
3 other student drivers in the motor vehicle as passengers.
4 B. The parent or legal guardian of a student driver may sign a
5 waiver which would allow the student driver to ride as a passenger
6 in a motor vehicle that is being operated by another student driver.
7 The waiver shall be on a separate form and include the following
8 statement: "I understand if my child is a passenger in a motor
9 vehicle operated by a student driver, there is a risk of death,
10 serious injury, or collision". If the parent or legal guardian
11 refuses to sign the waiver, the commercial driver training school or
12 school district shall not refuse to admit the student driver.
13 C. As used in this section, "student driver" shall mean any
14 person receiving driver education training who is younger than
15 eighteen (18) years of age.
