7 An Act relating to health care; amending 59 O.S.
7 2021, Section 650, which relates to interventional
8 pain management; modifying, adding, and deleting
8 definitions; authorizing Certified Registered Nurse
9 Anesthetist to provide certain services and operate
9 certain facilities under specified conditions;
10 providing certain construction; and providing an
10 effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 59 O.S. 2021, Section 650, is
14
15 amended to read as follows:
15
16 Section 650. A. This act section shall be known and may be
16
17 cited as the “Oklahoma Interventional Pain Management and Treatment
17
18 Act”.
18
19 B. As used in this section:
19
20 1. “Chronic pain” means a pain state which is subacute,
20
21 persistent and intractable;
21
22 2. “Fluoroscope” means a radiologic instrument equipped with a
22
23 fluorescent screen on which opaque internal structures can be viewed
23

1 as moving shadow images formed by the differential transmission of

2 X-rays throughout the body
2
3 “Fluoroscopy” means a medical imaging procedure that uses an X-
3
4 ray beam to take real-time footage of moving internal body parts
4
5 such as bones, muscles, joints, organs, and tissue to display a
5
6 consistent radiographic picture progressively onto a screen; and
6
7 3. “Interventional pain management” means the practice of
7
8 medicine delivery of health care services devoted to the diagnosis
8
9 and treatment of chronic pain, through the use of such techniques
9
10 as:
10
11 a. ablation of targeted nerves,
11
12 b. percutaneous precision needle placement within the
12
13 spinal column with placement of drugs such as local
13
14 anesthetics, steroids, and analgesics in targeted
14
15 areas of the spinal column, or
15
16 c. surgical techniques, such as laser or endoscopic
16
17 diskectomy, intrathecal infusion pumps and spinal cord
17
18 stimulators, or
18
19 d. fluoroscopy.

20 C. It shall be unlawful to practice or offer to practice
20
21 interventional pain management in this state unless such person has:
21
22 1. Has been duly licensed under the provisions of the Oklahoma
22
23 Allopathic Medical and Surgical Licensure and Supervision Act or the
23
24 Oklahoma Osteopathic Medicine Act; or

1 2. Is a Certified Registered Nurse Anesthetist licensed in
1
2 accordance with the Oklahoma Nursing Practice Act who holds a valid
2
3 certification in Nonsurgical Pain Management from the National Board
3
4 of Certification and Recertification for Nurse Anesthetists and
4
5 practices in accordance with the certification.
5
6 D. Nothing in this section shall be construed to forbid the
6
7 administration of lumbar intra-laminar epidural steroid injections
7
8 or peripheral nerve blocks by a certified registered nurse
8
9 anesthetist when requested to do so by a physician and under the
9
10 supervision of A Certified Registered Nurse Anesthetist who meets
10
11 the criteria of subsection C of this section may:

12 1. Practice interventional pain management, except for surgical
12
13 techniques, in collaboration with an allopathic or osteopathic
13
14 physician licensed in this state and under conditions in which
14
15 timely on-site consultation by such allopathic or osteopathic
15
16 physician is available.
16
17 E. A certified registered nurse anesthetist shall not operate;
17
18 2. Operate a freestanding pain management facility without
18
19 direct supervision of a in collaboration with an allopathic or
19
20 osteopathic physician who is board-certified in interventional pain
20
21 management or its equivalent; and
21
22 3. Perform procedural sedation.
22
23 E. Nothing in this section shall authorize a Certified
23
24 Registered Nurse Anesthetist to prescribe or dispense any opioid or

1 any other controlled dangerous substance to be taken by the patient
1
2 offsite for the management of chronic pain.

3 SECTION 2. This act shall become effective November 1, 2023.
