8 An Act relating to teacher certification; requiring
the State Department of Education to code initial
9 teacher certification; creating the Data Governance
Council; prescribing duties of Council; providing for
10 membership of Council; establishing deadlines for
initial appointment and meeting of Council;
11 prescribing frequency of meetings; setting meeting
quorum requirement; providing staffing and support
12 for Council; prohibiting compensation for members of
Council; subjecting Council to the Oklahoma Open
13 Meeting Act and Oklahoma Open Records Act; providing
exemption from dual office-holding prohibitions;
14 providing for codification; and providing an
effective date.

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
18 SECTION 1. NEW LAW A new section of law to be codified
19 in the Oklahoma Statutes as Section 6-188.1 of Title 70, unless
20 there is created a duplication in numbering, reads as follows:
21 The State Department of Education shall develop a system to code
22 initial teacher certification in order to report data on the
23 pathways for initial teacher certification, including emergency
24 certification and full-time adjunct certification.

1 SECTION 2. NEW LAW A new section of law to be codified
2 in the Oklahoma Statutes as Section 6-188.2 of Title 70, unless
3 there is created a duplication in numbering, reads as follows:
4 A. There is hereby created the Data Governance Council.
5 B. The Council shall:
6 1. Monitor and evaluate the impact of each teacher
7 certification pathway, including emergency certification and full-
8 time adjunct certification, as reported by the State Department of
9 Education pursuant to Section 1 of this act, on education outcomes
10 in the state;
11 2. Identify essential data elements indicative of teacher
12 workforce quality and ensure these elements are appropriately
13 defined and standardized for acceptable uses across certification
14 pathways; and
15 3. Establish best practices in data management and storage
16 processes to ensure security, privacy, and appropriate integration.
17 C. The Council shall be comprised of thirteen (13) members as
18 follows:
19 1. The Chancellor of the Oklahoma State Regents for Higher
20 Education, or designee;
21 2. The State Superintendent of Public Instruction, or designee;
22 3. The Secretary of Education, or designee;
23 4. The Executive Director of the Office of Educational Quality
24 and Accountability, or designee;

1 5. One member who is an employee of the State Department of
2 Education, designated by the State Superintendent of Public
3 Instruction;
4 6. One member who is part of an organization or association
5 representing school district boards of education in the state,
6 appointed by the Speaker of the Oklahoma House of Representatives;
7 7. One member who is part of an organization or association
8 representing school administrators in the state, appointed by the
9 President Pro Tempore of the Oklahoma State Senate;
10 8. One member who is an elementary or secondary public school
11 teacher in the state, appointed by the Governor; and
12 9. Five members representing deans, directors, or coordinators
13 from accredited, university-based educator preparation programs in
14 the state, appointed as follows:
15 a. two members appointed by the Speaker of the Oklahoma
16 House of Representatives,
17 b. two members appointed by the President Pro Tempore of
18 the Oklahoma State Senate, and
19 c. one member appointed by the Governor.
20 D. Appointments to the Council shall be made by no later than
21 December 1, 2023. The first meeting of the Council shall be called
22 by the State Superintendent of Public Instruction no later than
23 February 1, 2024. At the first meeting, the members of the Council
24 shall elect a chair and vice-chair from among the members. Meetings

1 of the Council shall be held at least quarterly at the call of the
2 chair. Members shall serve at the pleasure of their appointing
3 authorities. A majority of the members of the Council shall
4 constitute a quorum to transact business, but no vacancy shall
5 impair the right of the remaining members to exercise all of the
6 powers of the Council. A vacancy on the Council shall be filled by
7 the original appointing authority. The State Department of
8 Education, Office of Educational Quality and Accountability, and the
9 Oklahoma State Regents for Higher Education shall provide staff,
10 support, and information as requested by the Council.
11 E. Members of the Council shall receive no compensation for
12 serving on the Council.
13 F. The Council shall act in accordance with the provisions of
14 the Oklahoma Open Meeting Act and the Oklahoma Open Records Act.
15 G. Members who serve on the Council shall be exempt from the
16 dual office-holding prohibitions of Section 6 of Title 51 of the
17 Oklahoma Statutes.
18 SECTION 3. This act shall become effective November 1, 2023.
