7           An Act relating to Higher Education; creating the
            Sergeant CJ Nelson Legacy Act; amending 70 O.S. 2021,
8           Section 3218.7-1, which relates to waiver of room and
            board fees for children of commissioned members of
9           Oklahoma Law Enforcement; directing for the waiver of
            room and board fees for surviving children of first
10          responders who have given their lives in the line of
            duty; setting time period; defining terms; directing
11          for waiver of career technology district fees for
            surviving children of first responder who have given
12          their lives in the line of duty; setting time period;
            defining terms; providing for noncodification; and
13          providing an effective date.

16   BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
17       SECTION 1.       NEW LAW       A new section of law not to be
18   codified in the Oklahoma Statutes reads as follows:
19       This act shall be known and may be cited as "The Sergeant CJ
20   Nelson Legacy Act".
21       SECTION 2.        AMENDATORY       70 O.S. 2021, Section 3218.7-1, is
22   amended to read as follows:

1        Section 3218.7-1    A.   Within The Oklahoma State System of Higher
2    Education, no fees nor room and board shall be charged to the
3    children:
4        1.    Children of Oklahoma peace officers as defined by Section
5    648 of Title 21 of the Oklahoma Statutes who have given their lives
6    in the line of duty;
7        2.    Children of Oklahoma firefighters who have given their lives
8    in the line of duty;
9        3.    Children of commissioned members of the Oklahoma Law
10   Enforcement Retirement System, who have given their lives in the
11   line of duty; and
12       4.    Children of Oklahoma emergency medical technicians who have
13   given their lives in the line of duty.
14       B.    Such waiver of room and board shall be limited to a period
15   of five (5) years.
16       C.    Such waiver of room and board shall be a service benefit of
17   a commissioned member of the Oklahoma Law Enforcement Retirement
18   System.
19       D.    For purposes of this section:
20       1.    "Firefighter" means a volunteer firefighter or a permanent
21   salaried professional member of any fire department within the State
22   of Oklahoma; and
23       2.    "Emergency medical technician" means a person volunteering
24   or employed as an emergency medical technician and who is licensed

1    as an emergency medical technician pursuant to Section 1-2505 of
2    Title 63 of the Oklahoma Statutes.
3        SECTION 3.       NEW LAW    A new section of law to be codified
4    in the Oklahoma Statutes as Section 14-134.1 of Title 70, unless
5    there is created a duplication in numbering, reads as follows:
6        A.    Within the system of career technology districts, no fees
7    shall be charged to:
8        1. Children of Oklahoma peace officers as defined by Section 648
9    of Title 21 of the Oklahoma Statutes who have given their lives in
10   the line of duty;
11       2. Children of Oklahoma firefighters who have given their lives
12   in the line of duty;
13       3. Children of commissioned members of the Oklahoma Law
14   Enforcement Retirement System, who have given their lives in the
15   line of duty; and
16       4. Children of Oklahoma emergency medical technicians who have
17   given their lives in the line of duty.
18       B.    Such waiver of room and board shall be limited to a period
19   of five (5) years.
20       C.    Such waiver of room and board shall be a service benefit of
21   a commissioned member of the Oklahoma Law Enforcement Retirement
22   System.
23       D. For purposes of this section:
