7 An Act relating to agriculture; providing that the
State Board of Agriculture shall be the official
8 plant pest and disease control agency; providing
Board has authority to promulgate and enforce rules;
9 providing for issuance of emergency orders; providing
for expiration of emergency orders; providing for
10 codification; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. NEW LAW A new section of law to be codified
15 in the Oklahoma Statutes as Section 2-33 of Title 2, unless there is
16 created a duplication in numbering, reads as follows:
17 A. The State Board of Agriculture shall be the official plant
18 pest and disease control agency of the State of Oklahoma. The Board
19 shall have authority to promulgate and enforce rules governing plant
20 pests and plant protection, including quarantine.
21 B. In addition to other statutory authority, the state plant
22 regulatory official, upon obtaining concurrence of the State Board
23 of Agriculture, may issue emergency orders governing plants in order

1 to protect the citizens and plants of the state from diseases and
2 pests. The emergency order may:
3 1. Prohibit or impose conditions on importing plants or
4 implements of husbandry into the state;
5 2. Require testing of pests or plants;
6 3. Require any treatment of pests or plants;
7 4. Prohibit or impose conditions on moving plants or implements
8 of husbandry within the state;
9 5. Issue stop movement orders for all plants in the state to
10 determine the precise location of a plant pest or disease;
11 6. Govern the disposition of plants; and
12 7. Impose other measures governing plants to protect the
13 citizens and plants of the state from diseases and pests.
14 C. Emergency orders issued pursuant to this section shall
15 expire on the date set in the order or ninety (90) days after the
16 date the order was issued; however, the state plant regulatory
17 official may renew the order for successive ninety–day periods.
18 SECTION 2. This act shall become effective November 1, 2023.
