7 An Act relating to the Oklahoma Firefighters Pension
7 and Retirement System; amending 11 O.S. 2021, Section
8 49-101.2, as amended by Section 4, Chapter 232,
8 O.S.L. 2022 (11 O.S. Supp. 2022, Section 49-101.2),
9 which relates to volunteer firefighters considered to
9 be paid firefighters; modifying compensation
10 determination; increasing monthly benefit to be
10 received by retirees; and providing for codification.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 11 O.S. 2021, Section 49-101.2, as
14
15 amended by Section 4, Chapter 232, O.S.L. 2022 (11 O.S. Supp. 2022,
15
16 Section 49-101.2), is amended to read as follows:

17 Section 49-101.2. Any member serving as an active volunteer
17
18 firefighter who receives annual compensation from the fire
18
19 department the firefighter is enrolled in as a member of the System
19
20 for services related to firefighting, other than reimbursement of
20
21 expenses in excess of five and one-half (5 1/2) times the annual
21
22 pension benefit paid by the System to a retired volunteer
22
23 firefighter with twenty (20) years credited service Nine Thousand
23
24 Nine Hundred Thirty-nine Dollars and sixty-nine cents ($9,939.69),

1 shall be considered a paid firefighter and must meet the physical

2 and agility requirements pursuant to Section 49-116 of this title to
2
3 continue as an active member of the System. Credited service earned
3
4 as a paid firefighter pursuant to this section shall not be
4
5 considered actual experience as a paid firefighter for purposes of
5
6 meeting the qualifications of a paid fire chief as provided in
6
7 Section 29-102 of this title. No fire department of a participating
7
8 municipality shall employ a volunteer firefighter from another fire
8
9 department to perform services relating to firefighting for any
9
10 compensation of any kind.

11 SECTION 2. NEW LAW A new section of law to be codified
11
12 in the Oklahoma Statutes as Section 49-143.8 of Title 11, unless
12
13 there is created a duplication in numbering, reads as follows:
13
14 Any member of the Oklahoma Firefighters Pension and Retirement
14
15 System receiving benefits as of June 30, 2024, who continues to
15
16 receive benefits on or after July 1, 2024, shall receive a benefit
16
17 equal to Ten Dollars ($10.00) for each year of credited service not
17
18 to exceed thirty (30) years of service.
