7 An Act relating to voter registration; amending 26
7 O.S. 2021, Section 4-112, as amended by Section 18,
8 Chapter 282, O.S.L. 2022 (26 O.S. Supp. 2022, Section
8 4-112), which relates to registration applications;
9 authorizing secretary of county election board to
9 utilize certain technology for certain purpose; and
10 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 26 O.S. 2021, Section 4-112, as
14
15 amended by Section 18, Chapter 282, O.S.L. 2022 (26 O.S. Supp. 2022,
15
16 Section 4-112), is amended to read as follows:
16
17 Section 4-112. A. The Secretary of the State Election Board
17
18 shall devise and distribute a registration application form to be
18
19 used for registering voters. Such registration application shall
19
20 contain the following information:
20
21 1. The applicant’s full name and date of birth, county and
21
22 place of residence, and mailing address pursuant to the provisions
22
23 of subsection G of this section;

1 2. A space or section to designate a political party recognized

2 by the laws of the State of Oklahoma with which the applicant
2
3 chooses to be affiliated;
3
4 3. The Oklahoma driver license or identification card number if
4
5 the applicant has been issued a current and valid driver license or
5
6 identification card by Service Oklahoma, or if the applicant does
6
7 not have a valid Oklahoma driver license or identification card, the
7
8 last four digits of the voter’s Social Security number;
8
9 4. An oath of the eligibility of the applicant to become a
9
10 registered voter; and

11 5. Such other information as may be deemed necessary by the
11
12 Secretary to identify such applicant and to ascertain his or her
12
13 eligibility.

14 B. A voter registration application shall be signed by the
14
15 applicant in writing. The applicant shall personally subscribe his
15
16 or her name to or make his or her mark on the application, and no
16
17 agent, representative or employee of the applicant may sign or mark
17
18 on the applicant’s behalf. The signature or mark must be the
18
19 original, handwritten signature, autograph or mark of the applicant.
19
20 No facsimile, reproduction, typewritten or other substitute
20
21 signature, autograph or mark will be valid. Notwithstanding any law
21
22 to the contrary, the Secretary of the State Election Board shall
22
23 prescribe procedures to authorize any person incapable of personally
23
24 making a mark to complete a voter registration application with

1 assistance of an official of any voter registration agency or

2 licensed operator specified in Sections 4-109.2 and 4-109.3 of this
2
3 title. Provided, for applications submitted electronically, in lieu
3
4 of the signature requirements set forth in this subsection, the
4
5 applicant shall consent to the use of his or her driver license or
5
6 identification card signature as provided in Section 4-109.4 of this
6
7 title.

8 C. Persons who do not indicate a recognized political party or
8
9 political organization on their registration application shall be
9
10 designated as Independents.

11 D. Any person may apply in writing to the Secretary of the
11
12 State Election Board for permission to print, copy or otherwise
12
13 prepare and distribute the registration applications designed by the
13
14 Secretary of the State Election Board. The Secretary may revoke any
14
15 such permission at any time.

16 E. All registration applications shall be distributed to the
16
17 public at no charge.

18 F. The Secretary also shall prescribe procedures to accept and
18
19 use the National Mail Voter Registration Form, or its successor, as
19
20 required by the National Voter Registration Act of 1993. Provided,
20
21 to be accepted as a valid voter registration application, the form
21
22 shall include the applicant’s original, handwritten signature,
22
23 autograph or mark as described in subsection B of this section.

1 G. Applicants for voter registration or for change of voter

2 registration in any way shall provide a residence address and, if
2
3 different from the residence address, a mailing address. A
3
4 residence address shall include the street address of the residence,
4
5 including a full house number, street name or number, apartment or
5
6 suite number, if applicable, and zip code. If a street address is
6
7 not available for the residence, applicants shall provide such
7
8 information as the Secretary of the State Election Board deems
8
9 necessary for voter registration purposes. A post office box may
9
10 not be given as a residence address. A mailing address, which shall
10
11 include the city and zip code, may be the actual emergency
11
12 notification or 911 address on file in the local community, a rural
12
13 route and box number, a post office box number or a street address.

14 The secretary of a county election board may utilize global
14
15 positioning system (GPS) technology to ensure a voter is assigned to
15
16 the appropriate precinct.

17 H. A full or partial Social Security number or driver license
17
18 number in a voter registration record or a voter registration
18
19 application shall not be considered a public record and shall be
19
20 kept confidential by the State Election Board and each county
20
21 election board.

22 SECTION 2. This act shall become effective November 1, 2023.
