7 An Act relating to boats; amending 47 O.S. 2021,
7 Section 1107.5, as amended by Section 119, Chapter
8 282, O.S.L. 2022 (47 O.S. Supp. 2022, Section
8 1107.5), which relates to transfer of title in
9 transfer-on-death form; modifying inclusions; and
9 providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1107.5, as
13
14 amended by Section 119, Chapter 282, O.S.L. 2022 (47 O.S. Supp.
14
15 2022, Section 1107.5), is amended to read as follows:
15
16 Section 1107.5. A. The title of a motor vehicle or boat that
16
17 is not subject to any lien or other encumbrance may be transferred
17
18 in transfer-on-death form by filing with Service Oklahoma a written
18
19 notice of transfer signed by the transferor and designating the
19
20 transferee. Such notice shall transfer ownership of the vehicle or
20
21 boat to the transferee upon the death of the transferor. The notice
21
22 shall include:

23 1. The vehicle identification number of the vehicle or hull
23
24 identification number of the boat;

 1 2. The number of the license plate issued to the vehicle, if

2 any;

3 3. The full name and address of the transferor;
3
4 4. The full name and address of the transferee; and
4
5 5. The signature of the transferor. The signature or consent
5
6 of or notice to the transferee shall not be required for any purpose
6
7 during the lifetime of the transferor.

8 B. A designation of the transferee may be revoked or changed at
8
9 any time prior to the death of the transferor by filing an amended
9
10 notice with Service Oklahoma.

11 C. To accept a certificate of title of a motor vehicle or boat
11
12 pursuant to notice filed under subsection A of this act, the
12
13 designated transferee shall execute an affidavit verifying the death
13
14 of the transferor owner and submit to Service Oklahoma. After the
14
15 date of the transfer of the vehicle or boat as evidenced by the
15
16 submitted affidavit and the records of Service Oklahoma, Service
16
17 Oklahoma shall issue a title reflecting the transfer of ownership.

18 SECTION 2. This act shall become effective November 1, 2023.
