7 An Act relating to parental rights; creating the
7 Parental Rights Immunization Act; providing short
8 title; requiring health care provider to obtain

9 vaccinating child; requiring health care provider to
9 provide certain information; providing for
10 codification; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 2006 of Title 25, unless there
15
16 is created a duplication in numbering, reads as follows:

17 A. This section shall be known and may be cited as the
17
18 “Parental Rights Immunization Act”.
18
19 B. Each health care provider who administers a vaccine set
19
20 forth in the Vaccine Injury Table, as established by the United
20
21 States Department of Health and Human Services, shall obtain
21
22 informed consent from the legal representative or other adult
22
23 authorized by law to consent on behalf of a minor to whom such
23
24 provider intends to administer such vaccine. Prior to administering

1 the vaccine, the health care provider shall provide relevant

2 information regarding benefits and risks of the vaccine as well as
2
3 information concerning the National Vaccine Injury Compensation
3
4 Program.

5 C. Providing a copy of the Vaccine Information Statement, the
5
6 source of which is clearly identified, and making available for
6
7 review the Centers for Disease Control and Prevention’s
7
8 “Epidemiology and Prevention of Vaccine-Preventable Diseases:
8
9 Vaccine Excipient and Media Summary”, the Centers for Disease
9
10 Control and Prevention’s Vaccine Injury Table or the Centers for
10
11 Disease Control and Prevention’s contraindications and precautions
11
12 or any combination of these three resources to the legal
12
13 representative or other adult authorized by law to consent on behalf
13
14 of a minor shall constitute a minimum standard of relevant
14
15 information.

16 SECTION 2. This act shall become effective November 1, 2023.
