7 An Act relating to health insurance; amending 36 O.S.
2021, Section 6060, which relates to mammography
8 screenings; defining terms; specifying insurance
coverage of certain mammograms; and providing an
9 effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13 SECTION 1. AMENDATORY 36 O.S. 2021, Section 6060, is
14 amended to read as follows:
15 Section 6060. A. For the purposes of this section,:
16 1. "Breast magnetic resonance imaging" means a diagnostic tool
17 used to produce detailed pictures of the structure of the breast;
18 2. "Breast ultrasound" means a noninvasive, diagnostic imaging
19 technique that uses high-frequency sound waves to produce detailed
20 images of the breast;
21 3. "Diagnostic examination for breast cancer" means a medically
22 necessary and appropriate examination, as determined by a clinician
23 who is evaluating the individual for breast cancer, to evaluate the
24 abnormality in the breast that is:

1 a. seen or suspected from a screening examination for
2 breast cancer,
3 b. detected by another means of examination, or
4 c. suspected based on the medical history of family
5 medical history of the individual.
6 This examination may include, but is not limited to, a
7 diagnostic mammogram, breast magnetic resonance imaging, or a breast
8 ultrasound;
9 4. "Diagnostic mammography" means a diagnostic tool that:
10 a. uses X-ray, and
11 b. is designed to evaluate abnormality in a breast;
12 5. "Health benefit plan" means any plan or arrangement as
13 defined in subsection C of Section 6060.4 of this title;
14 2. 6. "Low-dose mammography" means:
15 a. the x-ray examination of the breast using equipment
16 specifically dedicated for such purpose, with an
17 average radiation exposure delivery of less than one
18 rad mid-breast and with two views for each breast,
19 b. digital mammography, or
20 c. breast tomosynthesis;
21 3. 7. "Breast tomosynthesis" means a radiologic mammography
22 procedure involving the acquisition of projection images over a
23 stationary breast to produce cross-sectional digital three-

1 dimensional images of the breast from which breast cancer screening
2 diagnoses may be made; and
3 8. "Screening mammography" means a radiologic procedure
4 provided to a woman, who has no signs or symptoms of breast cancer,
5 for the purpose of early detection of breast cancer, including
6 breast tomosynthesis.
7 B. All health benefit plans shall include the coverage
8 specified by this section for a low-dose mammography screening and a
9 diagnostic examination for the presence of occult breast cancer.
10 Such coverage shall not:
11 1. Be subject to the policy deductible, co-payments and co-
12 insurance limits of the plan; or
13 2. Require that a female undergo a mammography screening at a
14 specified time as a condition of payment.
15 C. 1. Any female thirty-five (35) through thirty-nine (39)
16 years of age shall be entitled pursuant to the provisions of this
17 section to coverage for a low-dose mammography screening once every
18 five (5) years.
19 2. Any female forty (40) years of age or older shall be
20 entitled pursuant to the provisions of this section to coverage for
21 an annual low-dose mammography screening.
22 SECTION 2. This act shall become effective November 1, 2022.
