7 An Act relating to a prison system training program;
7 providing for a hospice care training program within
8 the state prison system; authorizing the Department
8 of Corrections, the State Department of Health and
9 the Oklahoma Department of Career and Technology
9 Education to determine training requirements;
10 providing for review of applicants; providing for
10 program completion certificates; providing authority
11 for promulgation of rules; providing construing
11 provision; providing for codification; and providing
12 an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 1-863 of Title 63, unless there
17
18 is created a duplication in numbering, reads as follows:

19 A. The Department of Corrections may develop a hospice care
19
20 training program within the state prison system. The Department of
20
21 Corrections, in cooperation with the State Department of Health and
21
22 the Oklahoma Department of Career and Technology Education, may
22
23 jointly partner in the program to determine the appropriate training
23
24 for the purposes of obtaining licensure and/or certification

1 required for inmates selected to participate in the program. The

2 State Department of Health shall consider program participants in
2
3 the process of promulgating rules establishing the appropriate
3
4 licensure or certification requirements.

5 B. The State Department of Health shall review applicants to
5
6 the program prior to enrollment to ensure there are no state or
6
7 federal restrictions or prohibitions preventing the applicant from
7
8 obtaining licensure upon completion of the program. Inmates with
8
9 convictions pursuant to the provisions of Section 1-1950.1 of Title
9
10 63 of the Oklahoma Statutes are prohibited from participation unless
10
11 written permission to participate is granted by the State Department
11
12 of Health.

13 C. The Department of Corrections, the State Department of
13
14 Health and the Oklahoma Department of Career and Technology
14
15 Education shall jointly approve program curriculum for the training
15
16 of eligible inmates currently in the custody of the Department of
16
17 Corrections. The curriculum shall include required program credits
17
18 for each subject and practical skills instruction. Training shall
18
19 be provided by a licensed physician, registered nurse or other
19
20 appropriately licensed or trained health care professional, as
20
21 determined by the State Department of Health and the Oklahoma
21
22 Department of Career and Technology Education.

23 D. Upon successful completion of the training program provided
23
24 for in subsection C of this section, the Department of Corrections

1 shall issue a program completion certificate to the inmate. The

2 Department of Corrections in cooperation with the State Department
2
3 of Health and the Oklahoma Department of Career and Technology
3
4 Education shall develop a process for submission of notice of
4
5 training completion and application for licensure or certification
5
6 to the State Department of Health as prescribed by the State
6
7 Department of Health.

8 E. The State Department of Health, in consultation with the
8
9 Department of Corrections shall have authority to promulgate rules
9
10 for the implementation of the curriculum, as provided for in
10
11 subsection C of this section, and for continuing education or
11
12 training requirements necessary for maintaining state certification
12
13 in good standing.
13
14 F. Nothing in this Section shall be construed as establishing a
14
15 right to employment with any licensed hospice provider.
15
16 SECTION 2. This act shall become effective November 1, 2021.
