7 An Act relating to school employees; directing each
7 school district board of education to adopt certain
8 policy for school district employees who are
8 lactating; requiring each school district to make a
9 reasonable effort to provide certain room or other
9 location for an employee to express milk or
10 breastfeed a child; providing for codification;
10 providing an effective date; and declaring an
11 emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 5-149.3 of Title 70, unless
16
17 there is created a duplication in numbering, reads as follows:

18 A. Each school district board of education in this state shall
18
19 adopt a policy allowing a school district employee who is lactating
19
20 reasonable paid break time each day to use a designated lactation
20
21 room for the purpose of maintaining milk supply and comfort. The
21
22 break time may run concurrently with any break time, paid or unpaid,
22
23 already provided to the employee.

 1 B. Each school district board of education shall make a

2 reasonable effort to provide a private, secure and sanitary room or
2
3 other location, other than a toilet stall, where an employee can
3
4 express her milk or breastfeed her child.
4
5 SECTION 2. This act shall become effective July 1, 2021.
5
6 SECTION 3. It being immediately necessary for the preservation
6
7 of the public peace, health or safety, an emergency is hereby
7
8 declared to exist, by reason whereof this act shall take effect and
8
9 be in full force from and after its passage and approval.
