The proposed bill, known as the Women Expansion of Learning and Labor Safety (WELLS) Act, mandates that hospitals develop and implement discharge plans for pregnant patients who are admitted and expected to be discharged before delivery. Specifically, the bill requires that by January 1, 2027, hospitals must create a discharge plan for pregnant individuals exhibiting signs of labor, which includes a clinical justification for discharge, assessment of travel distance and transportation, identification of alternative facilities for labor and delivery, and confirmation that the plan has been reviewed by a qualified practitioner. Additionally, the pregnant individual or their representative must receive a copy of the discharge plan in their primary language and confirm their understanding of its contents.
Before discharging a pregnant individual, hospitals are required to include the discharge plan in the patient's medical record, provide a copy to the individual or their representative, and discuss the plan with them. The bill also empowers the director of health to adopt necessary rules for implementation, ensuring compliance with the outlined requirements.
