The proposed bill, known as the Keep Them Safe Act, seeks to establish guidelines and civil immunity for the voluntary storage of firearms in Ohio. It introduces a new section, 2923.26, to the Revised Code, which defines key terms such as "legal cause," "federally licensed firearms dealer," and "law enforcement agency." The bill allows individuals who hold legal title to a firearm to store it with a federally licensed dealer or a law enforcement agency, provided they follow specific regulations. These include ensuring that the dealer's federal firearms license is valid and that all federal laws regarding firearms are adhered to during the storage process.
Additionally, the bill provides civil immunity to federally licensed firearms dealers and law enforcement agencies for any injuries or losses related to the storage or return of firearms, unless they act with malicious intent. It also mandates the Attorney General to create an application form for firearm storage and to issue standard operating procedures and guidance for dealers and agencies. Importantly, the bill clarifies that there is no obligation for dealers or agencies to accept firearms for storage, nor to do so free of charge. If a court finds that a dealer or agency wrongfully withheld a firearm, it allows for the recovery of reasonable costs and attorney's fees for the aggrieved party.
