The bill amends sections 3313.718 and 3314.141 of the Revised Code to allow students in Ohio schools to possess and use both epinephrine autoinjectors and nasal epinephrine delivery devices for the treatment of anaphylaxis. The amendments specify that students must have written approval from a prescriber and, if they are minors, from a parent or guardian. The prescriber's approval must include detailed information about the student, the medication, and instructions for use, as well as emergency contact numbers. Additionally, the school principal and, if applicable, the school nurse must receive copies of these approvals, and a backup dose of the medication must be provided.

The bill also establishes liability protections for school districts and employees regarding the use of these devices. It states that they are not liable for any harm resulting from their decisions to allow or prohibit a student from using an autoinjector or nasal device based on their good faith belief regarding compliance with the conditions set forth in the bill. This protection extends to chartered nonpublic schools and community schools as well. The existing sections 3313.718 and 3314.141 are repealed, and the new provisions are intended to enhance the safety and management of anaphylaxis in school settings.
