The bill enacts new sections 3727.81, 3727.811, and 5119.192 of the Revised Code, which require hospitals to provide overdose reversal drugs to patients under specific circumstances. At the time of discharge from the emergency department, hospitals must provide an overdose reversal drug to patients who exhibit symptoms of an opioid overdose or related issues, unless certain conditions apply, such as the treating practitioner's judgment against it, the patient already possessing the drug, or the hospital lacking a supply. Additionally, hospitals must provide information on the drug's use, opioid use disorder treatments, and harm reduction strategies.
Hospitals that dispense these drugs are required to document each occurrence and submit reports to the departments of health and behavioral health, ensuring patient confidentiality. The bill also establishes that the department of behavioral health will supply overdose reversal drugs to hospitals, contingent on available funding, and outlines the process for hospitals to seek reimbursement for the drugs provided to patients covered by health benefit plans or Medicaid. Furthermore, the bill protects hospitals and their staff from liability related to the provision of these drugs.
