A BILL
To amend section 3319.143 of the Revised Code 1
regarding policies for assault leave at 2
educational service centers. 3
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 3319.143 of the Revised Code be 4
amended to read as follows: 5
Sec. 3319.143. Notwithstanding section 3319.141 of the 6
Revised Code, the board of education of a city, exempted 7
village, local or joint vocational school district or the 8
governing board of an educational service center may adopt a 9
policy of assault leave by which an employee who is absent due 10
to physical disability resulting from an assault which occurs in 11
the course of board employment will be maintained on full pay 12
status during the period of such absence. A board of education 13
or governing board electing to effect such a policy of assault 14
leave shall establish rules for the entitlement, crediting, and 15
use of assault leave and file a copy of same with the department 16
of education and workforce. A board of education or governing 17
board adopting this policy shall require an employee to furnish 18
a signed statement on forms prescribed by such board to justify 19

the use of assault leave. If medical attention is required, a 20
certificate from a licensed physician stating the nature of the 21
disability and its duration shall be required before assault 22
leave can be approved for payment. Falsification of either a 23
signed statement or a physician's certificate is ground for 24
suspension or termination of employment under section 3311.82 or 25
3319.16 of the Revised Code. 26
Assault leave granted under rules adopted by a board of 27
education or governing board pursuant to this section shall not 28
be charged against sick leave earned or earnable under section 29
3319.141 of the Revised Code or leave granted under rules 30
adopted by a board of education pursuant to section 3311.77 or 31
3319.08 of the Revised Code. This section shall be uniformly 32
administered in those districts where such policy is adopted. 33
Section 2. That existing section 3319.143 of the Revised 34
Code is hereby repealed. 35
