SUMMARY
▪ Increases the penalty for voyeurism to a third degree felony if the offender has previously
been convicted of or pleaded guilty to two or more violations of the offense.
DETAILED ANALYSIS
Voyeurism
Under continuing law, a person commits the offense of voyeurism, in part, by, for the
purpose of sexually arousing or gratifying the person’s self, committing trespass or otherwise
surreptitiously invading the privacy of another, to spy or eavesdrop on another.1 A violation of
this prohibition is a third degree misdemeanor. Under the bill, if a person has been convicted of
or pleaded guilty to two or more violations of this prohibition, a violation of this prohibition is a
third degree felony.2
