A BILL
To amend section 340.07 of the Revised Code to 1
authorize county commissioners to act in the 2
place of a board of certain alcohol, drug 3
addiction, and mental health service districts 4
when managing and spending the budget of the 5
district. 6
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 340.07 of the Revised Code be 7
amended to read as follows: 8
Sec. 340.07. The board of county commissioners of any 9
county participating in an alcohol, drug addiction, and mental 10
health service district or joint-county district, upon receipt 11
from the board of alcohol, drug addiction, and mental health 12
services of a resolution so requesting, may appropriate money to 13
such board for the operation, lease, acquisition, construction, 14
renovation, and maintenance of community addiction services 15
providers, community mental health services providers, and 16
facilities in accordance with the budget required by section 17
340.08 of the Revised Code and approved by the department of 18
mental health and addiction services pursuant to section 5119.22 19

A board of county commissioners, by resolution approved by 21
a vote of all the members of the board, may disapprove of the 22
budget proposed or approved under section 340.08 of the Revised 23
Code of a board of alcohol, drug addiction, and mental health 24
services of an alcohol, drug addiction, and mental health 25
service district comprised solely of that county. Upon 26
certification of this resolution to the board of alcohol, drug 27
addiction, and mental health services, that board shall 28
immediately cease spending funds in accordance with that budget 29
and shall not spend funds in accordance with that budget or any 30
subsequent budget until such time as the board of county 31
commissioners rescinds that resolution and certifies that 32
rescission to the board of alcohol, drug addiction, and mental 33
health services. A board of county commissioners that approves 34
such a resolution may act in place of the board of alcohol, drug 35
addiction, and mental health services in adopting or modifying a 36
budget in accordance with division (A) of section 340.08 of the 37
Revised Code or authorizing spending in accordance with that 38
budget. If the board of county commissioners exercises this 39
authority, the board shall continue to meet all elements of the 40
community addiction and mental health services plan developed 41
under section 340.03 and approved under section 5119.22 of the 42
Revised Code. 43
Section 2. That existing section 340.07 of the Revised 44
Code is hereby repealed. 45
