A BILL
To amend section 2313.06 of the Revised Code to 1
require names submitted by the Bureau of Motor 2
Vehicles to be included on the annual jury 3
source list. 4
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 2313.06 of the Revised Code be 5
amended to read as follows: 6
Sec. 2313.06. (A) The commissioners of jurors shall 7
compile a new and complete jury source list annually in 8
accordance with both of the following: 9
(1)(a) Except as otherwise provided in division (A)(1)(b) 10
of this section, on a date ordered by the court of common pleas, 11
the board of elections for each county shall compile and file 12
with the commissioners of jurors of the county a certified, 13
current list containing the names, addresses, and dates of birth 14
of all the electors of the county shown on the registration 15
lists for the most recent general election. The board of 16
elections shall remove from the list of all electors those 17
electors who have failed to vote at least once during the 18

preceding four consecutive years. The voter list so compiled 19
shall be the current voter list. 20
(b) The current voter list shall not include any elector 21
who has a confidential voter registration record, as described 22
in section 111.44 of the Revised Code. 23
(2)(a) Except as otherwise provided in division (A)(2)(b) 24
of this section, on a date ordered by the court of common pleas 25
of any particular county, the registrar of motor vehicles shall 26
compile and file with the commissioners of jurors of each county 27
a certified, current list containing the names, addresses, dates 28
of birth, and citizenship of all residents of the particular 29
county who have been issued, on or after January 1, 1984, a 30
commercial driver's license pursuant to Chapter 4506. or a 31
driver's license or identification card pursuant to Chapter 32
4507. of the Revised Code that is valid and current on the date 33
of the compilation of the list, who are or will be eighteen 34
years of age or older as of the day of the general election of 35
the year in which the list is filed, and who, regardless of 36
whether they actually are registered to vote, would be electors 37
if they were registered to vote. 38
(b) The list compiled under division (A)(2)(a) of this 39
section shall not include any person who has provided to the 40
registrar of motor vehicles an address designated by the 41
secretary of state to use as the person's address because the 42
person is a program participant in the address confidentiality 43
program described in sections 111.41 to 111.99 of the Revised 44
Code. 45
(B) In compiling the annual jury source list, the 46
commissioners, unless otherwise ordered by the court of common 47
pleas, shall include all names from the current voter list and 48

may include all names for from the certified, current list of 49
all names provided to the commissioners from by the registrar of 50
motor vehicles; provided that, upon merging the lists, any 51
duplication shall be eliminated. The commissioners shall exclude 52
from the annual jury source list the names of any jurors 53
permanently excused under section 2313.14 of the Revised Code 54
and the names of any jurors discharged under section 2313.21 of 55
the Revised Code. 56
(C) The annual jury source list so compiled shall be 57
certified by the commissioners and filed in their office before 58
the beginning of each jury year. The names shall be entered in a 59
suitable book or record, to be known as the "annual jury source 60
list," and shall be arranged alphabetically. With each name 61
shall be recorded the place of residence, date of birth, and 62
citizenship of the person as nearly as they can be ascertained. 63
A duplicate of the list shall be certified by the commissioners 64
and filed in the office of the clerk of the court of common 65
pleas. 66
(D)(1) Except as otherwise provided in division (D)(2) of 67
this section, the commissioners may, by order of the court, 68
supplement the annual jury source list with the names of persons 69
who, after the list has been filed, are discovered to be 70
qualified to serve as jurors. The commissioners shall certify 71
any supplemental jury source list and file it in their office 72
and in the office of the clerk of the court of common pleas. Any 73
supplemental jury source list shall be added to the annual jury 74
source list, and the supplemented annual jury source list shall 75
be used for the rest of the jury year. 76
(2) A supplemental jury source list shall not include any 77
person who appears to the commissioners to be a program 78

participant in the address confidentiality program described in 79
sections 111.41 to 111.99 of the Revised Code. 80
Section 2. That existing section 2313.06 of the Revised 81
Code is hereby repealed. 82
