A BILL
To amend section 3599.24 of the Revised Code to 1
increase the criminal penalty for intimidating 2
an election officer. 3
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 3599.24 of the Revised Code be 4
amended to read as follows: 5
Sec. 3599.24. (A) No person shall do any of the following: 6
(1) By force, fraud, or other improper means, obtain or 7
attempt to obtain possession of the ballots, ballot boxes, or 8
pollbooks; 9
(2) Recklessly destroy any property used in the conduct of 10
elections; 11
(3) Attempt to intimidate an election officer, or prevent 12
an election official from performing the official's duties; 13
(4) Knowingly tear down, remove, or destroy any of the 14
registration lists or sample ballots furnished by the board of 15
elections at the polling place; 16

(5) Loiter in or about a registration or polling place 17
during registration or the casting and counting of ballots so as 18
to hinder, delay, or interfere with the conduct of the 19
registration or election; 20
(6) Remove from the voting place the pencils, cards of 21
instruction, supplies, or other conveniences furnished to enable 22
the voter to mark the voter's ballot. 23
(B) Whoever violates division (A)(1) or , (2), or (3) of 24
this section is guilty of a felony of the fifth degree. Whoever 25
violates division (A)(3), (4)(A)(4), (5), or (6) of this section 26
is guilty of a misdemeanor of the first degree. 27
Section 2. That existing section 3599.24 of the Revised 28
Code is hereby repealed. 29
