A RESOLUTION
To urge the U.S. Environmental Protection Agency to 1
withdraw its proposed regulations on greenhouse 2
gas emissions and to urge the United States 3
Congress to take action to prevent the 4
regulations from taking effect. 5
BE IT RESOLVED BY THE SENATE OF THE STATE OF OHIO:
WHEREAS, The United States Environmental Protection Agency 6
(USEPA) has proposed new regulations governing greenhouse gas 7
emissions from coal and natural gas-fired power plants; and 8
WHEREAS, The proposed regulations require unachievable and 9
unrealistic timelines to reduce carbon emissions, which will 10
negatively impact the economic viability of new and existing 11
natural gas plants and all but ensure coal power plants will 12
need to shut down by 2035; and 13
WHEREAS, The proposed regulations will require the adoption 14
of new technologies, such as those related to clean hydrogen and 15
carbon capture, that are not yet commercially available and have 16
not been adequately demonstrated as required by the federal 17
Clean Air Act; and 18
WHEREAS, Adoption of the proposed regulations will 19

jeopardize energy reliability and result in more blackouts, 20
higher costs, and greater uncertainty for American families and 21
businesses; and 22
WHEREAS, The proposed regulations exceed USEPA's regulatory 23
authority and grant USEPA vastly expanded powers with major 24
economic and political significance without Congressional 25
assent; and 26
WHEREAS, The proposed regulations disregard the "major 27
questions doctrine" raised by recent U.S. Supreme Court rulings 28
and are inconsistent with the text, structure, and context of 29
Section 111 of the federal Clean Air Act; now therefore be it 30
RESOLVED, That we, the members of the Senate of the 135th 31
General Assembly of the State of Ohio, urge the USEPA to halt 32
its efforts to adopt the proposed regulations; and be it further 33
RESOLVED, That we, the members of the Senate of the 135th 34
General Assembly of the State of Ohio, urge the United States 35
Congress to enact clear legislation to prevent the USEPA from 36
adopting the proposed regulations; and be it further 37
RESOLVED, That the Clerk of the Senate transmit duly 38
authenticated copies of this resolution to the President Pro 39
Tempore and Secretary of the United States Senate, the Speaker 40
and Clerk of the United States House of Representatives, the 41
members of the Ohio Congressional delegation, the Administrator 42
of the USEPA, and the news media of Ohio. 43
