TITLE OF BILL:
An act to amend the estates, powers and trusts law, in relation to the
signature or attesting witnesses to a will
 
PURPOSE:
Relates to the timeframe for the signature of attesting witnesses to a
will.
 
SUMMARY OF PROVISIONS:
Section 1. Subparagraph 4 of paragraph (a) of section 3-2.1 of the
estates, powers and trust law is amended to include language "whether
the testator is alive or not"
Section 2. Establishes the effective date.
 
JUSTIFICATION:
Under current law, it does not stipulate if the Testator needs to be
alive when the witnesses attest to the testator's signature during the
30 day period. This bill amends the law to include language that states
the testator may or may not be alive.
