TITLE OF BILL:
An act to amend the environmental conservation law, in relation to
radioactive waste disposal
 
PURPOSE:
This bill requires radioactive waste to be considered hazardous waste so
that impacted sites can be remediated using funds from the Hazardous
Waste Superfund.
 
SUMMARY OF PROVISIONS:
Section one of the bill removes the exception for nuclear material from
the definition of hazardous waste.
Section two adds nuclear waste to the identification process of hazard-
ous waste. Section three sets the effective date.
 
EXISTING LAW:
The State's Hazardous Waste Superfund program does not cover radiologi-
cal contamination.
 
JUSTIFICATION:
Current state law prohibits our own Hazardous Waste Superfund for being
used for sites that suffer from radiological contamination. While the
state often partners with the federal government on these remediation
projects, New York should be able to martial its own resources and make
sure that the people living on these sites are protected.
