BILL NUMBER: S10567
SPONSOR: RAMOS
TITLE OF BILL:
An act to amend chapter 831 of the laws of 1981, amending the labor law
relating to fees and expenses in unemployment insurance proceedings, in
relation to the effectiveness thereof
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to extend for two years provisions in Labor
Law that relate to fees and expenses for unemployment insurance
proceedings.
SUMMARY OF PROVISIONS:
Section 1 of this bill would extend provisions in section 538 of Labor
Law that relate to fees and expenses for unemployment insurance
proceedings until December 31, 2028. These provisions direct the Unem-
ployment Insurance Appeal Board to establish qualifications and proce-
dures for the registration of agents to represent claimants and require
the UIAB to maintain lists of these agents for such claimants upon
request. In addition, agents seeking authorization are required to post
a $500 bond for the benefit of claimants charged certain fees by the
Agent.
Section 2 is the effective date.
JUSTIFICATION:
Chapter 831 of the Laws of 1981, which has been extended every two years
since, ensures that claimants are properly represented and not charged
unfair fees. Extending these provisions regarding the registration proc-
ess allows claimants access to qualified agents.
