TITLE OF BILL:
An act to amend chapter 138 of the laws of 1998, amending the navigation
law and the state finance law relating to the operation of personal
watercraft and specialty prop-craft, in relation to the effectiveness
thereof
PURPOSE:
To extend the effectiveness of certain provisions of law governing the
operation of personal watercraft and specialty prop-craft by extending
the expiration date of existing requirements.
SUMMARY OF PROVISIONS:
Section 1 amends section $ of chapter 138 of the laws of 1998, as previ-
ously amended, to extend the expiration date of section five of such act
from January 1, 2027 to January I, 2029. The amendment continues the
phased. applicability of boating safety certificate requirements for
operators of personal watercraft and specialty prop-craft and preserves
the authority of the commissioner of parks, recreation. and historic
preservation to modify applicable dates by rule or regulation upon a
finding that sufficient, courses are not available.
Section 2 provides that the act shall take effect immediately.
JUSTIFICATION:
The amended language of this bill extends the effectiveness of existing
personal watercraft and specialty prop-craft safety provisions to ensure
continuity of operator training and certification requirements. By
extending the expiration date, the
legislation allows additional time for the continued implementation
and administration of boating safety requirements while maintaining
regulatory flexibility to address course availability.
