TITLE OF BILL:
An act in relation to authorizing the commissioner of general services
provide compensation to Catholic Guardian Services for certain expenses
in connection with holding property for the purposes of providing hous-
ing and shelter for homeless, destitute, refugee, delinquent and/or
disabled persons in New York city
 
PURPOSE:
Authorizes the Commissioner of the Office of General Services to reim-
burse Catholic Guardian Services for fair and equitable holding expenses
associated with lands transferred to Catholic Home Bureau, which are
being reverted to the State for sale at auction.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 authorizes the Commissioner of the Office of General Services
to compensate Catholic Guardian Services for fair and equitable holding
expenses, as determined by the Commissioner, associated with property
located at 2322 Valentine Avenue in Bronx County, which is being
reverted to the State.
Section 2 provides the effective date.
 
JUSTIFICATION:
This legislation is to effectuate the release of the reverter and
revesting of title under that certain Letters of Patent, dated August
24, 2005, recorded on January 20, 2006 in the City Register's Office,
County of Bronx at CRFN 2006000036695. In order to effectuate the
reverter, the State and Catholic Guardian Services, successor in inter-
est to Catholic Home Bureau, intend to enter into a letter agreement
wherein Catholic Guardian Services will provide a deed to the State to
be held in escrow. The State will then hold a public auction for the
property under Section 33 of the Public Lands Law. The deed will be
released from escrow at the closing and the State will convey the prop-
erty to the successful auction bidder. The State has agreed to reimburse
Catholic Guardian Services for certain fair and holding expenses to be
determined by the Commissioner of the Office of General Services (OGS),
which will be a percentage of protective costs and expenses previously
paid by Catholic Guardian Services. The legislation is needed in order
to give the OGS Commissioner the authority to make such reimbursement
payment to Catholic Guardian Services in connection with the reverter
and sale process.
