TITLE OF BILL:
An act to authorize the town of Hamburg to extend the Big Tree fire
protection district into the village of Blasdell
PURPOSE OF BILL:
Authorizes the Town of Hamburg to extend the Big Tree fire protection
district into the Village of Blasdell in order to maintain basic fire
protection services to the residents and businesses of such Village.
SUMMARY OF PROVISIONS:
Section one. Authorizes the Town of Hamburg to extend the Big Tree fire
protection district into the Village of Blasdell.
§2. Authorizes the Town of Hamburg to have all the powers and duties
vested in and imposed on town boards pursuant to section 184 of the Town
law as it relates to the expanded fire protection district.
§3. Authorizes the Big Tree Volunteer Firemen's Company, Inc. to main-
tain apparatus and facilities within the Village of Blasdell for the
furnishing of fire protection, should it choose to do so and expressly
identifies that the Town of Hamburg shall maintain control of such fire
corporation for purposes of the not-for-profit corporation law.
§4. Permits extension of the fire protection district only after the
adoption of resolution by the Town of Hamburg as required by section 170
of the Town law.
§5. Sets forth the effective date.
JUSTIFICATION:
According to the Village of Blasdell, Erie County, declining enrollment
of active volunteer firefighters within its Volunteer Fire Department
has rendered its ability to meet basic fire protection needs nearly
impossible. This home rule legislation, requested by both the Village
and the Town of Hamburg, will authorize the adjoining volunteer fire
company to provide essential fire protection services to the residents
and businesses in said Village.
