TITLE OF BILL:
An act to amend the not-for-profit corporation law, in relation to
exempting the East Herkimer Volunteer Fire Department No.1, Inc. from
the requirement that the percentage of non-resident fire department
members not exceed forty-five percent of the membership
 
PURPOSE:
The purpose of this bill authorizes the East Herkimer Volunteer Fire
Department to recruit volunteers outside of the existing residency
requirement percentage.
 
SUMMARY OF PROVISIONS:
Section 1 amends subparagraph 3 of paragraph (c) of section 1402 of the
not-for-profit corporation law, as amended by chapter 369 of the laws of
2025 to include East Herkimer Volunteer Fire Department No. 1 Inc.
Section 2 provides an effective date.
 
JUSTIFICATION:
The East Herkimer Volunteer Fire Department located in Herkimer County
requested legislation authorizing a change in residency requirements to
fill open positions within the Department and further increase recruit-
ment and retention levels of volunteers.
