TITLE OF BILL:
An act in relation to authorizing the village of New Berlin to alienate
and discontinue the use of certain parklands
PURPOSE:
The purpose of this bill is to authorize the Village of New Berlin to
alienate a portion of "Old Fair Ground Lot" and to convey this portion
of land to Good Shepards Communities in exchange for fair market value.
SUMMARY OF PROVISIONS:
Section 1 of the bill authorizes the Village of New Berlin to alienate a
plot of existing parkland and to convey this plot of land to Good
Shepards Communities.
Section 2 states that the Village of New Berlin can only take the
actions outlined in Section 1 if it dedicates a new plot of land to be
used as parkland and/or makes capital improvements to existing parkland
or recreational facilities.
Section 3 states the plot of land that the Village of New Berlin is
conveying to Good Shepard Communities, as described in the Village's
Official Tax Map.
Section 4 states that if the Village of New Berlin has ever used federal
funding or assistance to purchase, maintain, or improve this plot of
parkland, it must comply with all federal parkland alienation require-
ments before the plot is alienated.
Section 5 is the effective date.
JUSTIFICATION:
This legislation is necessary to authorize the Village of New Berlin to
alienate a limited portion of municipally-owned land, in furtherance of
a project that serves an important public purpose.
The Village has identified a parcel of land that is not presently
utilized for active recreational or park purposes as a potential site
for a project intended to support community needs.
The Village has undertaken a local review process, including public
engagement, to evaluate the proposed use of the property. This process
has informed the Village's determination that the proposed use of the
land is appropriate and in the interest of the community.
To ensure that the public trust is preserved, the Village intends to
acquire new parkland and/or make improvements to existing park and
recreational resources.
Accordingly, this legislation will enable the Village to advance a
locally supported initiative while preserving and reinvesting in public
recreational assets, and is therefore in the best interests of the
community.
