TITLE OF BILL:
An act to amend the retirement and social security law, in relation to
the effective date of a reclassification for an accidental disability
retirement benefit
PURPOSE:
To provide certain retirees approved for the World Trade Center Presump-
tion for Accidental Disability Retirement Benefit reclassification with
benefits as of the date their application is filed with the Office of
the State Comptroller.
SUMMARY OF PROVISIONS:
Sections 1- 10 of the bill amend various sections of the Retirement and
Social Security Law to provide that deteiininations made on applications
for World Trade Center Presumption for Accidental Disability Retirement
Benefits, which are submitted on or after January 1, 2027, will be
effective as of the date the application was filed with the Office of
the State Comptroller.
Section 11 of the bill provides that the provisions of this act are not
subject to section 25 of the Retirement of Social Security Law.
Section 12 sets forth the effective date of this act
JUSTIFICATION:
Generally, an eligible individual begins receiving retirement benefits
provided for in the Retirement and Social Security Law as of the date
their application was filed with the Office of the State Comptroller.
However, for benefits provided under the World Trade Center Presumption
for Accidental Disability Retirement Benefit reclassification, an eligi-
ble individual begins receiving such benefit as of the date their appli-
cation is approved by the Office of the State Comptroller.
This bill seeks to remedy that inconsistency and would allow individuals
approved for World Trade Center Presumption for Accidental Disability
Retirement Benefit reclassification to receive such benefits as of the
date of the application is filed.

EFFECTIVE DATE:
This act shall take effect immediately and shall apply to applications
submitted on or after January 1, 2027.
