TITLE OF BILL:
An act to amend chapter 274 of the laws of 2010 amending the environ-
mental conservation law relating to repair of damaged pesticide contain-
ers, in relation to the effectiveness thereof
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this legislation is to reduce the amount of products,
such as fertilizers that contain pesticides that may become waste by
allowing retailers and distributors to make minor repairs to containers
in accordance with the United States Environmental Protection Agency
(EPA) policy.
SUMMARY OF PROVISIONS:
Section 1 of the bill would amend Environmental Conservation Law 33-1301
to extend, until July I, 2028, to allowing retailers and distributors to
make minor repairs to pesticide containers in accordance with the EPA.
Section 2 of the bill provides that the bill shall take effect imme-
diately.
JUSTIFICATION:
The EPA released its "Pesticide Container Repair Interim Policy" in
October 2009 to address the environmental concerns associated with the
unnecessary disposal of consumer pesticide products, such as lawn ferti-
lizer containing pesticides. Specifically, according to the EPA, approx-
imately five million pounds of consumer pesticide products may become
waste each year in the United States due to damage to the containers
before the pesticides can be sold by retailers.
This bill would extend, until 2028, New York's existing "minor repair
program" for damaged pesticide containers and lawn fertilizers contain-
ing pesticides provided that the retailer's repair plan is approved
first by the EPA.

EFFECTIVE DATE:
