TITLE OF BILL:
An act to amend the public health law, in relation to information that
residential health care facilities are required to provide to residents
and their families
 
PURPOSE:
This bill expands the information that must be made available to resi-
dents and their families in a separate document as a part of an intake
application.
 
SUMMARY OF PROVISIONS:
Section one amends subdivision 13 of section 2803 of the public health
law by requiring residential health care facilities to include - in the
document they have to provide to residents and their families - an
explanation of the ownership structure of the facility, including the
current board of directors and/or members of any limited liability enti-
ty, and any contractors involved with major functions of the facility,
including staffing, food, and linen service. It would also require the
Department to publish this information on the New York State nursing
home profiles website.
Section two provides for the effective date.
 
JUSTIFICATION:
This bill aims at expanding the information which must be made available
to prospective residents and their families about residential health
care facilities. The information would include details regarding the
ownership structure of the facility, including the current board of
directors and/or members of any limited liability entity, and any
contractors involved with major functions of the facility, such as
staffing, food, and linen service.
By expanding the current information, transparency and accountability
are increased. Furthermore, it allows consumers and advocates to have a
clearer understanding of who they are able to address with concerns.
 
FISCAL IMPLICATIONS:
None.
 
EFFECTIVE DATE:
This act shall take effect immediately.
