TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to an
exemption for certain property from the prohibition of alcohol sales
within a certain distance from a church; and providing for the repeal of
such provisions upon expiration thereof
JUSTIFICATION:
This bill would waive the ABC Law's 200-foot law for the restaurant
operating at 1003 Second Avenue in Manhattan and allow the license
application to be considered by the State Liquor Authority ("SLA").
This space was leased to open a restaurant in a unit that previously
held another restaurant. As the prior establishment and its predecessors
dating back to the 1980s served alcohol at this location under full
liquor licenses from the SLA, the tenant understood that it would be
able to obtain the same license. A church, which is purportedly within
200 feet of the proposed establishment, has no objection to a full
liquor license at this location, and the local community board approved
the application unanimously.
This bill would allow for increased jobs, safety, commerce, and revenue
to the Turtle Bay area of Manhattan in a location in which restaurants
have operated for 40 years.
