TITLE OF BILL:
An act to amend the general municipal law, in relation to excluding
child day care providers from restrictions on receiving financial
assistance from industrial development agencies
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill would allow for child care providers to receive grant support
from industrial development agencies (IDAs) by amending the general
municipal law.
 
SUMMARY OF PROVISIONS:
Section 1 provides that child day care providers shall not be prohibited
from applying for and receiving assistance from industrial development
agencies (IDAs) due to their inclusion in the definition of exempt
"retail sales" facilities under general municipal law.
Section 2 sets forth the effective date to be immediate.
 
JUSTIFICATION:
Families across New York State rely on child care providers each day to
care for their children while they are away or working. Child care
providers truly perform an essential service, which both directly
strengthens the economy and enhances community well-being. As it stands
right now, for IDA purposes, daycare centers and homes facilitating
child care are considered "retail" because you have to cross the literal
threshold/doorway of the businesses to procure the service. Under exist-
ing state law, IDA's are not empowered to provide incentives to "retail"
establishments, meaning that these care providers are not able to get
any local incentives for their buildings/facilities. This bill would
amend the provision relating to the retail facility carve-out, to
specifically allow for child care providers to apply for and receive
local IDA incentives, supporting the development of this critical commu-
nity infrastructure.
