TITLE OF BILL:
An act to amend the social services law, in relation to raising daily
room and board rates at adult homes proportionally to increases in the
minimum wage in the city of New York
PURPOSE:
To prevent Adult Homes from absorbing unfunded labor cost mandates by
ensuring that increases in the New York City minimum wage are accompa-
nied by proportional increases in the Adult Home daily room-and-board
reimbursement rate.
SUMMARY OF PROVISIONS:
Section 1. Legislative findings and intent.
Section 2. Creates a new subdivision in SSL Section 461-c, SD 2-b, which
ties the NYC minimum wage increases to an equal percentage increase in
the Adult Home daily room and board rate.
Section 3. sets the effective date.
JUSTIFICATION:
The Adult Home's daily room and board rate has not received a NYS COLA
in 17 years, despite substantial increases in operating and labor costs.
Adult Homes are uniquely required to absorb mandated minimum wage
increases without receiving the corresponding. COLA adjustments that
nursing homes and shelters routinely receive. Current reimbursement
structures limit providers' ability to reward staff seniority and expe-
rience, weakening workforce stability and retention. Adult Homes are
vital parts of their communities. Many times, Adult Homes are some of
the largest employers in their respective neighborhoods.
