TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to the
exemption of certain parcels of land from licensing restrictions prohib-
iting manufacturers, wholesalers and retailers of alcoholic beverages
from sharing an interest in a licensed premises or to sell at retail for
consumption off the premises
PURPOSE:
The purpose of this bill is to create a narrow exemption in the Alcohol-
ic Beverage Control Law for Jazz at Lincoln Center in Manhattan.
SUMMARY OF PROVISIONS:
Section 1 amends section 101 of the Alcoholic Beverage Control Law to
add a new exemption for the specifically described Performing Arts Unit
condominium at the AOL Time Warner Center in Manhattan.
Section 2 adds a new subdivision 26 to section 105 of the law allowing a
business located within that defined condominium unit to hold an owner-
ship interest in a wholesale alcohol premise.
Section 3 sets the effective date.
JUSTIFICATION:
New York's tied house laws were enacted to prevent vertical integration
that could distort competition within the three tier alcohol system.
While those protections remain important, strict application can some-
times limit legitimate ownership structures even when there is no real-
istic threat of market dominance or undue influence.
This legislation creates a narrowly tailored, location specific
exemption for jazz at Lincoln Center in Manhattan. By confining the
exemption to the defined property, the bill preserves the broader regu-
latory framework while allowing operational flexibility at a prominent
cultural institution that contributes significantly to the city's
economic and artistic vitality.
