TITLE OF BILL:
An act to repeal certain provisions of the general business law, the
labor law, the civil service law, the domestic relations law, the educa-
tion law, the executive law, the railroad law, the social services law,
the workers' compensation law, the arts and cultural affairs law, the
county law, the public service law, the rapid transit law, the retire-
ment and social security law, the town law, the transportation law, the
transportation corporations law, the employers' liability law, the judi-
ciary law, the estates, powers and trusts law, the agriculture and
markets law, the public authorities law, the debtor and creditor law and
the Indian law, in relation to removing outdated provisions of law; and
to amend the domestic relations law, the education law, the railroad
law, the town law, the village law, the judiciary law, the arts and
cultural affairs law, the economic development law, the general business
law, the public lands law, the public officers law, the public service
law, the real property law, the real property actions and proceedings
law, the retirement and social security law, the second class cities
law, the state law, the general municipal law, the personal property
law, the transportation corporations law, the transportation law, the
vehicle and traffic law, the workers' compensation law, the employers'
liability law, the public authorities law and the correction law, in
relation to removing outdated terminology and provisions of law and
making technical corrections thereto
 
PURPOSE:
To remove outdated laws
 
SUMMARY OF PROVISIONS:
Section 1 repeals a section of law requiring certain international money
transfers to be conducted by steamboat
Section 2 repeals a section of law requiring seats on certain elevators
Section 3 amends a section of law that bars individuals engaged in
certain activities from public service
Section 4 removes requirements that members of certain races take
medical tests before getting married
Section 5 removes a section of law in conflict with the Child-Parent
Security Act
Section 6 amends a form that requires that the "year" on the form begin
with
Section 7 removes unconstitutional provisions barren subversives from
the education system
Section 8 removes other references.to subversive organizations from the
education law
Section 9 removes a censorship council meant to review textbooks for
certain material
Section 10 removes racist school segregation practices for Native Ameri-
can children
Section 11 removes a section of law allowing for the arrest of "truant"
Native American children
Section 12 amends outdated executive authority language
Section 13 removes regulations for long obsolete cable-operated trains
Section 14 provides conforming changes for section 13
Section 15 removes an existing penalty for bringing certain needy
persons into the state
Section 16 removes references to a lapsed organization for veterans of
the Spanish Civil War
Section 17 removes a section allowing for the arrest of politicians if
they fail to attend certain meetings
Section 18 removes pay schedules for long-dead employees
Section 19 removes laughably low caps on the salaries of judicial clerks
Section 20 removes a law allowing certain projectors to be built with
asbestos
Section 21-26 provide conforming changes for section 20
Section 27 regulates non-existent tuberculosis hospitals
Section 28 repeals provisions related to non-existent civil service
positions
Section 29 changes references from non-existent government energy agen-
cies to relevant, existing ones
Section 30 removes references to obsolete technology as purchasable
items for education
Section 31 removes committee a long-expired temporary advisory

JUSTIFICATION:
New York's law code is full of outdated and obsolete laws, and it's
about time they be removed. The proposed legislation focuses primarily
on technical corrections and the removal of redundant language from the
state's administrative code to ensure clerical consistency.
Working with Stanford researchers we identified thousands of outdated
laws, which we then narrowed down to about 60-80. We worked to ensure
that removal of these provisions would not create any unintended juris-
dictional gaps. Specific sections slated for deletion include outdated
regulations concerning the facilitation of international money transfers
using steamboats, requirements that elevators have chairs, and other
obsolete relics of the pre-industrial era.
All of the laws in this legislation are absurd, outdated, or serve no
positive purpose. We have an opportunity to clear some of the legisla-
tive cruft that has built up in New York throughout the years.
