TITLE OF BILL:
An act to amend the administrative code of the city of New York, in
relation to requiring the department of transportation to mark certain
potholes during paving projects
 
SUMMARY OF PROVISIONS:
Section 1 adds a new section 19-116.1 to the administrative code of the
city of New York to require that, during any street paving project
undertaken by the Department of Transportation, the department shall
mark with fluorescent paint any pothole deeper than one inch within the
area of such paving project.
Section 2 sets forth the effective date.
 
JUSTIFICATION:
Potholes are a frequent and hazardous feature on New York City streets.
Left unmarked, they can cause accidents, vehicle damage, and safety
risks for drivers, cyclists, and pedestrians. During paving projects,
potholes may be overlooked or temporarily obscured, leaving residents
vulnerable until final work is complete.
This bill ensures that the Department of Transportation takes a simple,
low-cost precaution-fluorescent paint marking-whenever a pothole deeper
than one inch is identified during a paving project. Clearly marking
these hazards will alert road users to their presence and help prevent
accidents and property damage.
By requiring visibility of known potholes during paving projects, this
legislation promotes safer streets, reduces liability exposure for the
city, and reinforces accountability in roadway maintenance.
