TITLE OF BILL:
An act to amend the penal law, in relation to falsely reporting an inci-
dent in the third degree
PURPOSE OR GENERAL IDEA OF BILL:
The bill would include using artificial intelligence or generative arti-
ficial intelligence within falsely reporting an incident in the third
degree.
SUMMARY OF PROVISIONS:
Section 1. Subdivision 1, Subdivision 2, Subdivision 3 and Subdivision 4
of Penal Law § 240.50 are amended to include using artificial intelli-
gence or generative artificial intelligence as defined by
§ 1700 of the general business law.
Section 2. Effective date.
JUSTIFICATION:
The false reporting of an incident to law enforcement agencies, emergen-
cy agencies or organizations, or statewide registers involving the abuse
or mistreatment of a vulnerable individual is detrimental to upholding
public safety, diverting resources unnecessarily and can potentially
result in tragic, preventable outcomes. Falsely reporting an incident
is illegal under existing law, however as criminals utilize emerging and
ever-evolving technologies such as artificial intelligence or generative
artificial intelligence to further their illegal activity it is vital
existing law ensure these actions are criminalized and offenders held
accountable.

EFFECTIVE DATE:
This act shall take effect immediately.
