TITLE OF BILL:
An act to amend the administrative code of the city of New York, in
relation to prohibiting a utility from charging customers an excise tax
PURPOSE OR GENERAL IDEA OF BILL:
This bill prohibits utility companies from shifting their excise tax
cost to customers
SUMMARY OF PROVISIONS:
Section 1 amends section 11-1102 of the administrative code of the city
of New York and adds a new subdivision h. This subdivision requires that
the tax imposed under this section be treated as an operating cost of
the utility and expressly prohibits utilities from passing this tax on
to customers in their bills.
JUSTIFICATION:
Utility costs present a significant burden for New Yorkers, one that is
further exacerbated when utilities pass along costs that are intended to
be their burden. By expressly prohibiting this practice, this bill
effectuates the intent of the tax and provides critical protection for
consumers.

EFFECTIVE DATE:
This act shall take effect on the sixtieth day after it shall have
become law.
