TITLE OF BILL:
An act to amend the criminal procedure law, in relation to granting
peace office status to the district attorney of Dutchess county
 
PURPOSE:
The purpose of this bill is to grant peace officer status to the
District Attorney of Dutchess County while acting within the scope of
official duties and jurisdiction. This designation will allow the
District Attorney to more effectively perform certain law enforcement-
related functions associated with the responsibilities of the office,
while maintaining existing safeguards regarding firearms licensure.
 
SUMMARY OF PROVISIONS:
Section one of the bill amends section 2.10 of the criminal procedure
law by adding a new subdivision to designate persons serving as the
District Attorney of Dutchess County as peace officers while acting
within the scope of their official duties and jurisdiction. The bill
explicitly provides that this designation does not authorize the carry-
ing, possession, repair, or disposal of a firearm unless the appropriate
license has been issued pursuant to section 400.00 of the penal law.
Section two provides that the act shall take effect immediately.
 
JUSTIFICATION:
This proposal aligns Dutchess County with other jurisdictions and States
where prosecutors or DA office investigators are statutorily designated
as peace officers. It brings local practice into harmony with recognized
models while maintaining appropriate training and firearms licensing
protocols.
