TITLE OF BILL:
An act to amend the public officers law, in relation to expanding
geographical boundaries for residency requirements of correction offi-
cers employed by local correction facilities
 
PURPOSE:
To allow correction officers employed by local municipalities contiguous
to another state to reside within a designated geographical boundary
within such contiguous state.
 
SUMMARY OF PROVISIONS:
Section 1 adds subdivision 2-e to Public Officers Law § 3 . It permits
uniformed, members of correctional facilities and sheriff's departments
to hold office while residing in the employing county, a contiguous New
York county, a contiguous state, or a county in a contiguous state with-
in 45 miles of the jurisdiction's boundary.
Section 2 amends the public officers law to include definitions, as used
in this chapter, for state officer, local officer, and uniformed member.
Section three adds subdivision 9 to Public Officers Law § 30, stipulat-
ing that a local office is not rendered vacant if a uniformed member of
a correctional or sheriff's department resides in a contiguous state,
provided their residence is located within 45 miles of the jurisdic-
tion's boundary.
Section four is the effective date.
 
JUSTIFICATION:
Local correctional facilities face ongoing difficulties with recruitment
of new correction officers, as well as retention of trained, experienced
officers. Elimination of the residency requirements contained within the
public officers law will allow municipal agencies to expand their
geographical search for correction officer candidates, as well as enable
such municipalities to retain experienced officers seeking domicile
within another state.

EFFECTIVE DATE:
This act shall take effect one year after it has become a law.
