TITLE OF BILL:
An act to amend the general business law, in relation to requiring
applications for retail gas station building permits to include electric
vehicle charging stations
PURPOSE:
Requires any new gas station builds to include electric vehicle charging
stations
SUMMARY OF PROVISIONS:
Section 1 adds a new section (396-xx) to the general business law that
defines retail gas station, dealer, charging station, direct current
fast charger, and electric vehicle. It then restricts a retail gas
station dealer from receiving a building permit unless the submitted
plans include the installation of at least one fast charging stat,ion
per four gas dispensing pumps. It exempts any retail gas station with
plans to build pumps of less than 4 gas dispensing pumps. No retail gas
station shall open for business until the charging stations are opera-
ble.
Section 2 is the effective date, which is one year after the act is
modified into law.
JUSTIFICATION:
The growth of electric vehicle adoption necessitates an accelerated
expansion of charging infrastructure. New York State law requires all
new passenger vehicles sold in the state to be electric by 2035. In
2023, approximately 8% of all new car purchases in New York were elec-
tric vehicles, and this share is projected to continue increasing as
automobile manufacturers transition to electric and hybrid models.
Enhanced access to charging stations will, in turn, support increased
electric vehicle adoption by alleviating range anxiety and improving the
convenience of EV ownership. At present, charging infrastructure is
insufficient to accommodate this anticipated growth. This bill would
ensure that new gas station development supports the transportation
needs of all New Yorkers by incorporating electric vehicle charging
capacity.
