TITLE OF BILL:
An act in relation to authorizing the county of Putnam to lease certain
lands used as parklands
PURPOSE OR GENERAL IDEA OF BILL:
Authorizes the county of Putnam to alienate certain lands used as park
land.
SUMMARY OF PROVISIONS:
Section 1: Provides that Putnam County can alienate certain parklands to
Homeland Towers, LLC for the purposes of installing a cell tower
Section 2: Specifies the legal definition of the parkland that is to be
alienated.
Section 3: Specifies the legal description of the easement provided for
in this act.
Section 4: Provides that if the leased lands cease to be used for the
cell tower, the lands shall revert back to parklands, the easement will
be extinguished, and the tower and associated equipment will be removed.
Section 5: Declares that if the county received federal funds for the
parkland, such parkland shall not be alienated until all federal
requirements are met.
Section 6: States the effective date.
JUSTIFICATION:
The legislature of Putnam County has adopted a resolution asking the
state of New York to enact a law allowing the county to alienate certain
parklands for the construction of a cell tower.
