TITLE OF BILL:
An act to amend a chapter of the laws of 2025 amending the general busi-
ness law and the mental hygiene law relating to requiring warning labels
on addictive social media platforms, as proposed in legislative bills
numbers S. 4505 and A. 5346, in relation to the legislative intent and
the effectiveness thereof; to amend the general business law, in
relation to warning labels on addictive feature platforms; and to repeal
section 7.48 of the mental hygiene law relating to addictive social
media platform warning labels
PURPOSE:
This is a chapter amendment to L.2025, c.689, to amend the legislative
intent, redefine the scope of the law, prescribe warning label language,
establish display requirements and restrictions, and make technical
amendments.
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter amendment by amending the
legislative intent, and redefining the scope of the law to be limited to
social media platforms that offer an addictive feed, autoplay and/or
infinite scroll. This legislation prescribes warning label language to
read "The Surgeon General has warned that while social media may have
benefits for some young users, excessive use may be associated with
significant mental health harms." The legislation establishes display
requirements and restrictions to require the appearance of the warning
label for specific durations of time based on usage, and makes technical
amendments.

JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 689 of the Laws of 2025. S.4505 and A.5346,
both passed the Senate and Assembly, respectfully, in June 2025.
FISCAL IMPLICATIONS:
None
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2025 amending the general business law, in
relation to requiring warning labels on addictive social media plat-
forms, as proposed in legislative bills numbers S.4505 and A.5346, takes
effect.
