TITLE OF BILL:
An act to amend the insurance law and the public health law, in relation
to the use of virtual credit cards by insurers and certain health care
plans; and to amend a chapter of the laws of 2025 amending the insurance
law and the public health law relating to the use of virtual credit
cards by insurers and certain health care plans, as proposed in legisla-
tive bills numbers S. 2105-A and A. 3986-A, in relation to the effec-
tiveness thereof
PURPOSE:
This is a chapter amendment that makes changes to provisions of L.2025,
c.647, to allow the use of alternative payment methods for claims.
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter in instances where the
provider does not respond to the insurer's request to pay by a virtual
credit card within 30 days. In such instances, the insurer shall pay the
providers with the alternative payment option offered when the insurer
made a request to pay by virtual card.
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 647 of the Laws of 2025. S.2105-A and
A.3986-A passed the Senate in June 2025 and Assembly in May 2025,
respectively.
FISCAL IMPLICATIONS:
None.
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2025 amending the insurance law relating to the
use of virtual credit cards by insurers and certain health care plans,
as proposed in legislative bills numbers S.2105-A and A.3986-A, takes
effect.
