TITLE OF BILL:
An act to amend the criminal procedure law and the mental hygiene law,
in relation to cases terminated due to mental disease or defect and to
establishing reporting obligations regarding such cases
 
PURPOSE:
This is a chapter amendment that makes changes to L.2025, C.675.
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by clarifying which
defendants will receive discharge planning and referrals to single
points of access depending on whether defendants are seen at an Office
of Mental Health (OMH) facility or nonOMH facility and the care they
received as required by law. It also enumerates the annual reporting
data required from OMH, to include the number of defendants committed to
OMH under final orders of observation, the originating counties of the
orders, and the institutions observing the defendants, as well as
specific reporting from OMH and non-OMH facilities.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.

EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2025 amending the Criminal Procedure Law relating
to cases terminated due to mental disease or defect, as proposed in
legislative bills numbers S.1744-A and A.2440-A, takes effect; provided,
however, section two of this act shall take effect January 1, 2027.
