TITLE OF BILL:
An act to amend the civil practice law and rules, in relation to time
frames for certain court filings; and to amend a chapter of the laws of
2025 amending the civil practice law and rules relating to enacting the
"avoiding vexatious overuse of impleading to delay (AVOID) act", as
proposed in legislative bills numbers S. 8071-A and A. 8728, in relation
to the effectiveness thereof
 
PURPOSE:
This is a chapter amendment that makes changes to L.2025, C.704.
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by limiting when a third-
party summons and complaint may be filed without a court order to no
more than 90 days after the subject answer is served, and prohibiting
third-party summons and complaint filing and service after the note of
issue is filed unless there is good cause shown or in the interest of
justice.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.

EFFECTIVE DATE:
This act shall take effect on the same date as a chapter of the laws of
2025 amending the civil practice law and rules relating to enact the
"avoiding vexatious overuse of impleading to delay (AVOID) act," as
proposed in legislative bills numbers S. 8071-A and A. 8728-A, takes
effect, provided however, the act shall only apply to cases commended on
or after the effective date.
